  • 3.2.1 NFT Submission: Users can submit their NFTs for inclusion in polls. Each NFT submission must comply with our content guidelines and intellectual property policies.
  • 3.2.2 Poll Mechanism: In each poll, community members vote on NFTs based on potential and value. The polls are equipped with functionalities allowing users to view the NFT owner’s followers and detailed descriptions of each NFT.
  • 3.2.3 Voting System: Each user is entitled to one vote per poll. Votes are cast by depositing tokens into the poll’s account. The outcome of the poll influences the distribution of these tokens.

3.4 Hub Creation and Management

  • 3.4.1 Hub Creation: Users can create “hubs” for various purposes, including discussions, competitions, or games. Each hub has customizable attributes such as title, duration, and content items (images, audio files, etc.).
  • 3.4.2 Privacy Settings: Hubs can be set as private (invite-only) or public. This setting determines the accessibility of the hub to the trendhub community.
  • 3.4.3 Financial Aspects: Hub creators may fund their hubs, and the distribution of these funds is based on user engagement and poll outcomes.

3.5 Token Use and Distribution

  • 3.5.1 Token Deposit: Participation in polls requires the deposit of tokens. These tokens are held in the poll’s account until the poll concludes.
  • 3.5.2 Distribution of Tokens: Upon poll conclusion, tokens are distributed among participants based on their engagement and the success of the NFTs they supported.

3.6 Modifications and Updates

trendhub reserves the right to modify, enhance, or discontinue any aspect of its services at any time. Changes will be communicated to users through the platform or via email.

Section 4 – User Registration and Accounts

4.1 Account Creation

  • Eligibility: To register an account on trendhub, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher. By creating an account, you represent and warrant that you meet this age requirement.
  • Account Information: When creating an account, you agree to provide accurate, current, and complete information as requested in the registration form. You are responsible for keeping this information up-to-date.

  • One Account per User: Each individual is allowed to create and maintain only one account. Duplicate accounts or shared accounts are not permitted.

5.1 NFT Submission Process

  1. Eligibility: Users wishing to submit Non-Fungible Tokens (NFTs) to trendhub must be registered members and comply with all platform guidelines.
  2. Submission Requirements: Each NFT submission should include a clear image, a detailed description, title, and any relevant attributes or metadata. The user must have legal ownership or the right to represent the NFT they submit.
  3. Approval Process: Submitted NFTs undergo a review process. trendhub reserves the right to reject any NFT submission that does not meet our quality standards or violates intellectual property rights.
  4. Responsibilities of Submitters: Users submitting NFTs are responsible for the accuracy of the information provided and must ensure compliance with copyright and other relevant laws.

5.2 Participation in Polls

  1. Voting Rights: Each registered user is entitled to one vote per poll. Votes are cast using the platform’s designated mechanism.
  2. Token Deposit for Voting: To participate in a poll, users must deposit a specified number of tokens into the poll’s account. This amount is specified for each poll and is non-refundable.
  3. Fair Play: Users must engage in polls in a fair and honest manner. Any manipulation of votes or use of unfair tactics is strictly prohibited and may result in account suspension or termination.

5.3 Poll Conduct

  1. Poll Duration: Each poll has a set start and end time. The duration of each poll will be clearly communicated on the platform.
  2. Transparency: During the poll, real-time results will be visible to all users. However, final results will be confirmed and announced only after the poll’s closure.
  3. User Engagement: Users are encouraged to engage with NFTs by commenting and sharing their opinions. All comments must adhere to community guidelines and be respectful.

5.4 Outcome of Polls

  1. Winning Criteria: The NFTs receiving more than 50% of the total votes in a poll will be declared winners. The criteria for winning may be adjusted for specific polls, and such adjustments will be communicated beforehand.
  2. Token Distribution: At the end of a poll, tokens deposited will be distributed among the winning participants in accordance with a pre-defined distribution key.
  3. Data Utilization: Data obtained from polls (such as vote counts, rankings) will be used to calculate a sales potential score and a value score for the NFTs, aiding in investment decisions.

5.5 Amendments and Cancellation

  1. Poll Amendments: trendhub reserves the right to amend poll rules or criteria as necessary. Any changes will be communicated to users in advance.
  2. Poll Cancellation: In exceptional circumstances, trendhub may cancel a poll. In such cases, deposited tokens will be returned to the participants.

5.6 Liability

  1. Platform Liability: trendhub is not liable for any losses incurred by participants due to poll outcomes.
  2. User Liability: Users are liable for any breaches of these terms and may be subject to penalties, including but not limited to, forfeiture of tokens, suspension, or termination of account.

6.1 Content Display

  • Carousel and Content Representation: On trendhub, content is dynamically showcased through a 3D carousel. This feature is accessible across both desktop and mobile platforms, enabling users to interact with content using mouse controls or touchscreen gestures. The carousel, upon stopping, highlights a central piece of content, ensuring focused visibility for selected items.
  • Content Information Display: Directly beneath the highlighted content, essential information such as the title, and the total number of likes or votes received at the end of the poll, are prominently displayed. This serves to provide immediate context and engagement metrics for users.
  • Dynamic Information Boxes: Accompanying the primary content display are three distinct information boxes:
    • Left Box (Engagement Data): This box displays the engagement data related to the content, including the number of followers of the content creator and overall engagement metrics for the NFT or content.
    • Middle Box (Content Description): Positioned directly below the main content, this box offers a detailed description of the content, allowing users to understand the context and background of the NFT or content.
    • Right Box (Comments): This box is dedicated to displaying comments specific to the content or general comments about the overall topic. Users have the option to select the content they wish to comment on via a drop-down menu.

6.2 User Interaction

  • Commenting and Engagement: Users are encouraged to actively participate by posting comments. The platform offers a streamlined process for selecting the specific content to comment on, fostering targeted and relevant discussions.
  • Sharing Mechanism: Below the information boxes, a sharing button is available, enabling users to share the content from the poll or topic on other social media platforms. This feature is designed to extend the reach of content and engage broader audiences.
  • Token and Link Display: The total number of tokens or links contributed by users in the poll is displayed beneath the sharing buttons. This feature offers transparency and insight into the level of engagement and participation in the poll.
  • Content Reporting and Moderation: trendhub is committed to maintaining a respectful and lawful environment. Users can report content that they find inappropriate or offensive. trendhub reserves the right to review and, if necessary, remove such content.

6.3 Community Guidelines

  • Respectful Interaction: Users are expected to engage respectfully and constructively. Harassment, hate speech, and other forms of offensive behavior will not be tolerated.
  • Intellectual Property: Users must respect the intellectual property rights of others. Content that infringes upon these rights is prohibited and subject to removal.
  • Accuracy of Information: Users are expected to provide accurate information in their comments and interactions. Misleading or false information is against the platform’s policy.

  • 7.1.1 Users of trendhub have the ability to create “Hubs” – interactive spaces for community engagement on various topics, including but not limited to games, surveys, and competitions.
  • 7.1.2 To create a Hub, users must complete the Hub Creation Form on the trendhub platform, providing necessary details like title, theme, and duration of the Hub.
  • 7.1.3 Each Hub must have clearly defined parameters, including the purpose (discussion, competition, survey, etc.), start and end dates, and the nature of content (images, audio files, code, etc.).
  • 7.1.4 Hub Creators can choose to make their Hub private (accessible only via invitation code) or public.

7.2 Content and Items in Hubs

  • 7.2.1 Each item within a Hub must be accompanied by an image, description, title, and relevant attributes.
  • 7.2.2 Creators are responsible for ensuring that all content within their Hub adheres to intellectual property laws and trendhub’s community guidelines.

7.3 Accessibility and Privacy

  • 7.3.1 The decision to make a Hub private or public must be specified at the creation stage.
  • 7.3.2 Private Hubs require an invitation code for access, ensuring controlled participation as per the Hub Creator’s preference.

7.4 Financial Aspects

  • 7.4.1 Hub creators have the option to inject funds into their Hub’s balance, which can be utilized for various purposes, including prize distribution.
  • 7.4.2 The distribution of funds from the Hub’s balance is contingent upon participant engagement and outcomes within the Hub.
  • 7.4.3 trendhub is not responsible for the management of funds within a Hub, and all financial transactions are subject to the terms of the payment processor used.

7.5 User Engagement and Rewards

  • 7.5.1 Hub creators may set up rewards or incentives for participants based on engagement or performance within the Hub.
  • 7.5.2 The criteria for rewards distribution must be clearly defined and communicated to participants at the beginning of the Hub activity.

7.6 Data Collection and Usage

  • 7.6.1 Data collected from Hub activities, such as user preferences and interactions, will be used by Hub creators to gain insights and may influence future content or product development.
  • 7.6.2 All data collection and usage must comply with trendhub’s Privacy Policy and applicable data protection laws.

7.7 Responsibility and Compliance

  • 7.7.1 Hub creators are solely responsible for the content and activities within their Hub.
  • 7.7.2 trendhub reserves the right to remove or disable access to any Hub that violates these terms, our community guidelines, or applicable laws.

7.8 Changes and Cancellation

  • 7.8.1 Hub creators can modify certain aspects of their Hub post-creation, subject to limitations set by trendhub.
  • 7.8.2 In the event of cancellation or significant alteration of a Hub, participants must be notified promptly.

7.9 Disputes and Resolution

  • 7.9.1 Any disputes arising within a Hub are to be resolved by the Hub creator. trendhub may offer mediation assistance but is not obligated to intervene.
  • 7.9.2 trendhub holds no liability for disputes arising within or related to Hubs.

7.10 Termination

  • 7.10.1 trendhub reserves the right to terminate any Hub if it fails to comply with these terms or for any other reason deemed necessary for the integrity and safety of the platform.

Section 8 – User Conduct and Obligations

8.1 Compliance with Laws

  • Users must comply with all applicable laws and regulations while using the trendhub platform. This includes, but is not limited to, laws related to copyright, privacy, and online conduct.

8.2 Prohibited Activities

  • Users are strictly prohibited from engaging in any form of harassment, discrimination, or behavior that is threatening, abusive, or harmful to others.

8.9 Consequences of Violation

  • Violations of these User Conduct and Obligations may result in a range of actions, including but not limited to warnings, suspension of account privileges, or permanent banning from the platform.
  • trendhub reserves the right to take legal action against users who commit unlawful acts or infringements of these terms.

Section 13 – Transaction and Payment Policies

13.1 General Transaction Guidelines

  1. Eligibility: Users must be registered on trendhub and have a valid account to initiate or participate in any transactions.
  2. NFT Participation: Only NFTs that meet trendhub’s submission criteria are eligible for participation in polls and other related activities.
  3. Token Usage: Users must possess sufficient tokens in their accounts to participate in voting, bidding, or any other transactional activities on trendhub.

13.2 Voting and Poll Participation

  1. Voting Process: Each user is entitled to one vote per poll, which requires a token deposit.
  2. Token Deposit: Upon voting, the equivalent number of tokens will be temporarily moved from the user’s account to the poll’s account.
  3. Vote Finality: Once cast, votes cannot be altered or withdrawn.

13.3 Transaction of Tokens

  1. Token Distribution: At the end of each poll, tokens in the poll’s account will be distributed among the winners based on a predetermined distribution key.
  2. Winner Determination: Winners are users who voted for NFTs that receive more than 50% of the total votes in a poll.
  3. Distribution Process: Token distribution to winners will be automated and subject to the rules encoded in the trendhub smart contract.

13.4 Financial Transactions

  1. Hub Balance Top-Up: Hub creators can top up their hub balance with money to facilitate prize distribution or other hub-related activities.
  2. Transaction Fees: trendhub may charge a nominal fee for certain transactions, including but not limited to NFT submissions, hub creations, and token purchases.

13.5 Revenue Sharing and Distribution

  1. Profit Sharing: Users who participate in polls and vote for popular NFTs may receive a share of the tokens from the losing side, based on the poll’s results.
  2. Distribution Mechanism: The distribution of profits will be in accordance with the smart contract’s predefined rules and the poll’s outcome.

13.6 Refunds and Cancellations

  1. Refund Policy: All token transactions are final. Refunds are not available except in cases of technical errors attributable to trendhub.
  2. Cancellation of Polls: In the event of poll cancellation due to unforeseen circumstances, tokens will be returned to the users’ accounts.

13.7 Dispute Resolution

  1. Dispute Handling: In case of disputes related to transactions, trendhub will facilitate resolution based on the platform’s policies and smart contract terms.
  2. User Cooperation: Users are required to cooperate in the dispute resolution process and provide necessary information as requested by trendhub.

13.8 Changes to Transaction Policies

  1. Policy Amendments: trendhub reserves the right to modify these transaction and payment policies at any time. Users will be notified of significant changes through their registered email or via platform notifications.
  2. Acceptance of Changes: Continued use of trendhub services after changes to these policies constitutes acceptance of the new terms.

13.9 Liability

  1. Limitation of Liability: trendhub is not liable for any loss incurred by users due to their participation in transactions, except in cases of proven negligence or misconduct by trendhub.
  2. Responsibility of Users: Users are responsible for ensuring they understand the terms of each transaction and for managing their accounts and tokens appropriately.

Section 14 – Disclaimer and Limitation of Liability

14.1 Disclaimer

14.1.1 trendhub provides its services “as is” and “as available” without any warranties of any kind, expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. trendhub does not guarantee the accuracy, completeness, or timeliness of the information, material, products, or services available through the platform.

14.1.2 trendhub makes no warranty that the platform will meet your requirements, be uninterrupted, timely, secure, or error-free, or that defects, if any, will be corrected.

14.1.3 trendhub is not responsible for technical, hardware, or software failures of any kind; lost or unavailable network connections; or incomplete, garbled, or delayed computer transmissions.

14.1.4 Under no circumstances will trendhub be liable for any damages or injury that result from the use of the materials on this site, and the user assumes full responsibility for all costs associated with all necessary servicing or repairs of any equipment used in connection with trendhub’s services.

14.2 Limitation of Liability

14.2.1 trendhub, including its directors, employees, agents, or contractors, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • (i) the use or the inability to use the service;
  • (ii) unauthorized access to or alteration of your transmissions or data;

  • (iv) or any other matter relating to the service.

14.2.2 trendhub’s total liability to you in connection with any claim arising out of or relating to the service shall not exceed the amount paid by you to trendhub during the twelve (12) month period immediately preceding the date on which the claim arose.

14.2.3 The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed its essential purpose.

All matters relating to your access to or use of trendhub, including all disputes, will be governed by the laws of Germany without regard to its conflicts of laws provisions.
  2. Jurisdiction: You agree that any legal action or proceeding between trendhub and you for any purpose concerning these Terms and Conditions or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Germany.
  3. Dispute Resolution:
    • Negotiation: In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms and Conditions or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties.
